Quick Start
To get your contract(s) on the market today, complete and provide the following 3 items to us, for each contract. We show you how, and where, to get each item:
- a signed listing agreement (this page) - it's the agreement you make with our brokerage to hire us to sell your contract for you, gives DVC admin permission to work with us on your behalf, and puts all fees and rules in writing, so you're never caught off guard
- a points statement you'll get from DVCmember.com so we can verify and correctly advertise the points in your contract to any new buyer
- a copy of your deed - it shows us your recorded your names for accurate entry on the sale contract, and Disney requires a copy sent with the right of first refusal submission
Fees to Sell
- There are never upfront fees to list your Disney Vacation Club contract with DVC by Resale. Our 8.5% commission beats most of our competitors because we've been in business since 2002 and keep our overhead low, so we can pass along the savings to you! If you bought or sold specifically through us before, we even give you a small discount to say, "Thank you!", for working with us again.
- Disney's current administrative fee is $150 per contract.
- The only other notable, but minimal expense is for notarizing the final documents. Some closing companies offer a Remote Online Notary service which, if offered, might be complimentary. The choice with whom you use as your notary is completely yours to make based on your own personal situation. If you prefer, just Google "public notary near me", and use someone nearby. Walk-in offices with notaries usually charge $5-$50.
That's it! For most clients, there are no other costs to sell unless you own at Disney's Aulani resort or aren't a US citizen
- Aulani sellers should be aware of the state of Hawaii's HARPTA tax. 7.25% of your sales price is held at closing and if you are not making a profit, you may apply to have it returned after the sale closes.
- International sellers be aware of the United States government's FIRPTA (Foreign Investment in Real Property Tax) act, which holds 15% of your sale at closing which you *most likely* can complete forms and have it or a portion, returned after closing. Please visit the IRS’s website for detailed information. IRS.gov You will also want to research notary costs in your country, as your final closing papers must be notarized and witnessed with your government issued identification.
How are Annual Dues handled?
- Annual dues are not pro-rated like a residential home sale. You didn't live in a house for 300 days while someone else is going to live in it for 65 days, which is why a home's taxes are pro-rated that way.
- Resale brokers look at the current calendar year's allocation of points and each party pays dues on the points they have used, or are getting, in the sale of the current year's allocation. Sellers who pre-pay the whole year will likely receive a credit at closing from the buyer for the points the buyer is getting from the current calendar year's allocation of points. Annual dues on banked points from the prior year are not typically reimbursed, but may justify a higher sales price than a contract without. Sellers who borrow ahead, typically credit the dues to a buyer for the used points from the next year, at a similar rate.
You're Not Locked In
DVC by Resale has always believed in our ability to do the job you hire us to do. That's why our agreement is non-exclusive. We have been successfully selling the Disney Vacation Club timeshares since 2002 and our broker, since 1997. Our listing agreement is non-exclusive, which means you can cancel anytime as long as we haven't already sent you a contract at your listed price, authorized reduced price or verbally accepted price with the terms agreed upon here.
Rules to Know About Selling Your DVC
The DVC by Resale company policy prohibits us from advertising any contract with reservations greater than 60 days from the date of a signed listing agreement. **Disney's rules state sellers can't have any reservations on a contract when it closes. All account activity should stop when it goes on the market. If you put your contract on the market and then change any points within the contract, you are committing an act of fraud. It is illegal for anyone to use points once a contract is on the market for sale.**
Disney does not allow you, or any seller, to transfer the perks that you may have been receiving because you bought directly from Disney Vacation Club. It's important to remember that fact for your value, along with a gentle reminder that the contract you sell today has less years than the contract you originally bought.
