Terms of Agreement
- Seller may not use, make reservations, or change status of points within the account without first notifying Timeshares By Resale, Inc. d/b/a DVC By Resale once property has been listed.
- No upfront listing fees, advertising fees, or appraisal fees are required. Your asking price must be less than the current price being offered by the developer.
- Conveyance of Title - Title shall be conveyed to the purchaser by Deed, free and clear of all encumbrances. Owner will provide their deed and (if requested) a title insurance policy showing that they have marketable title to the property.
- Closing- Buyer will be responsible for all closing costs incurred; seller is responsible for any transfer fees and commissions, unless stated differently in sales contract.
- Agency -Timeshares By Resale, Inc. d/b/a DVC By Resale acts as a Transaction Broker for both the buyer and the seller unless otherwise stated in writing.
- California and Hawaii residents and property owners agree to a co-broker cooperative agreement as detailed in the Listing Agreement Terms and Conditions
General Conditions
- This agreement is non-exclusive; you may use other brokers or agencies without cost or obligation to Timeshares By Resale, Inc. d/b/a DVC By Resale a Licensed Real Estate Broker, until under contract. Seller agrees to notify DVC By Resale immediately upon acceptance of a contract from any other entity.
- It is the owner's responsibility to contact Timeshares By Resale, Inc. d/b/a DVC By Resale in writing if the property is no longer available for sale. This will stop further efforts by us to secure a buyer. If we submit a contract to you at full price, your authorized reduced price or verbally accepted offer, we have earned our commission. If the property has been sold or taken off the market without written notice to us, we are due our full commission. Your signature on this document signifies agreement.
- All proceeds from the sale will be disbursed in a timely manner upon closing by the law firm or title company handling the closing.
- Owner shall indemnify and hold Timeshares By Resale, Inc. d/b/a DVC By Resale, its officers, and employees harmless against, and from any misrepresentations made herein by owner or owners resort, managing entity, resort developer or resort sales agents, or failure of owner to perform hereunder.
- Owner acknowledges that, due to extensive advertising and promotional programs incurred by Timeshares By Resale, Inc. d/b/a DVC By Resale, that the selling fees may be more than those charged in other types of real estate transactions. Commissions are currently 8.5%.
- This agreement will be in effect from the date of signing and will remain effective until cancelled in writing by either party. This listing is non-exclusive.
- There are no judgments or pending litigation against Broker resulting from or alleging a violation by Broker of Chapters 475, 498, 718, or 721 of the Florida Statutes, or resulting from or alleging consumer fraud on the part of the Broker.
- Governing Law. This Agreement shall be construed by and governed under the laws of the State of Florida, including its principles of conflicts of laws and the parties hereby irrevocably agree to submit to the jurisdiction and venue of the General Courts of the State of Florida, County of Orange, in the Ninth Judicial Circuit, to resolve any dispute arising hereunder or relating hereto. Particularly, but in no way of limitation, the parties agree that they are subject to the personal jurisdiction of the state and federal courts of Florida, and the parties waive the right to challenge the personal jurisdiction of those courts over the party.
- This agreement represents our entire understanding and merges and supersedes all prior representations whether written or oral.

FLORIDA LAW REQUIRES THAT REAL ESTATE LICENSEES PROVIDE THIS NOTICE TO POTENTIAL SELLERS AND BUYERS OF REAL ESTATE.
You should not assume than any real estate broker or sales associate represents you unless you agree to engage a real estate licensee in an authorized brokerage relationship, either as a single agent or as a transaction broker. You are advised not to disclose any information you want to be held in confidence until you make a decision on representation. DVC by Resale acts as a transaction broker in all transactions.
Residents of the state of California and non-California residents holding a California based deed are hereby notified that all real estate services provided through this website and brokerage are conducted cooperatively under the supervision of a California Licensed Real Estate Broker in compliance with onine regulatory laws for real estate.
Residents of the state of Hawaii and non-Hawaiian residents holding a Hawaii based deed are hereby notified that all real estate services provided through this website and brokerage are conducted cooperatively under the supervision of a Hawaii Licensed Real Estate Broker in compliance with onine regulatory laws for real estate.
